Terms and Conditions
Effective from 15 October 2026.
§ 1. General provisions
1. The artMonte online shop, available at artmonte.com (hereinafter: the “Shop”), is operated by STYL Przemysław Janik, ul. Walczaka 112, 66-400 Gorzów Wielkopolski, Poland, NIP PL5992901245 (hereinafter: the “Seller”).
2. Contact with the Seller: e-mail office@artmonte.com, postal address as above.
3. These Terms and Conditions set out the rules for using the Shop, placing orders, concluding and performing sales contracts, the rights and obligations of the parties and the complaints procedure.
4. The Shop sells within Poland and to other Member States of the European Union and selected European countries listed in the order form. The Polish-language version of the Terms and Conditions is the binding version; versions in other languages are provided for convenience only.
5. Contracts concluded through the Shop are concluded in Polish or - at the Customer's choice - in the language of the version of the Shop used by the Customer.
§ 2. Definitions
Customer - a natural person with full legal capacity, a legal person or an organisational unit without legal personality that places an order in the Shop.
Consumer - a Customer who is a natural person making a purchase not directly related to their business or professional activity, as well as a natural person concluding a contract directly related to their business activity where it follows from the content of the contract that it is not of a professional nature for that person.
Product - a reproduction print of a work of art made to the Customer's order, on a material chosen by the Customer (including Dibond, acrylic glass, PVC board, Dispa board, wallpaper), in the size and crop specified by the Customer in the Configurator.
Configurator - a tool in the Shop that allows the Customer to select an artwork, material, print width and height and a section of the artwork (crop), with automatic price calculation.
Order - the Customer's declaration of intent to conclude a contract for the sale of a Product, submitted using the order form.
§ 3. Nature of the Products
1. All Products are made to the Customer's individual order according to the parameters (artwork, material, size, crop) chosen by the Customer in the Configurator. The Shop does not sell ready-made prints from stock.
2. The reproduced works are in the public domain. The Seller uses digital reproductions made available under CC0 / public domain licences by museum institutions. The Customer acquires a physical print; the Customer does not acquire copyright or any rights to the digital files.
3. The preview in the Configurator is for illustration purposes only. Colours on screen may differ from the print due to monitor settings and the properties of the material (matt, gloss, transparency). Such differences do not constitute a defect of the Product.
4. Where proportions other than those of the artwork are selected, only the section of the artwork visible in the highlighted area of the Configurator at the time the Order is placed will be printed.
5. Wallpapers are printed in panels 50 cm wide. Rigid materials are supplied without a mounting system unless the material description states otherwise.
§ 4. Prices and payment
1. Prices in the Polish version of the Shop are quoted in Polish zloty (PLN) and in the other language versions in euro (EUR). Prices are gross prices and include VAT. The price does not include the cost of delivery, which is shown separately in the cart and in the Order summary before the Order is placed.
2. The price of a Product is calculated automatically in the Configurator on the basis of the selected material and the print area (price per m² × size), but not less than the minimum price for the given material. The binding price is the price shown in the Order summary at the time the Order is placed.
3. Prices in EUR are calculated from the base prices in PLN at the exchange rate applied by the Seller; the rate applied to a given Order is recorded in the Order and does not change.
4. Available payment methods:
a) online payment via the Autopay system (Autopay S.A., ul. Powstańców Warszawy 6, 81-718 Sopot): BLIK, instant bank transfer, payment card, Google Pay, Apple Pay - subject to availability in the given country and currency;
b) traditional bank transfer to the Seller's bank account - the transfer details are provided after the Order is placed.
5. The Customer is obliged to make payment within 7 days of placing the Order. Failure to pay within this period results in cancellation of the Order. Processing of the Order begins once the payment has been credited.
6. At the Customer's request the Seller issues a VAT invoice; invoice details must be provided in the Order form. The invoice is sent electronically to the e-mail address provided, to which the Customer consents.
§ 5. Placing an Order and conclusion of the contract
1. Orders may be placed 24 hours a day, 7 days a week. Placing an Order does not require creating an account.
2. To place an Order, the Customer: selects an artwork, selects the material, size and crop in the Configurator, adds the Product to the cart, completes the Order form (contact details, delivery address, payment method), accepts the Terms and Conditions and the Privacy Policy, and then clicks the “Order and pay” button (or its equivalent in another language version).
3. Clicking the “Order and pay” button constitutes an offer to purchase. The sales contract is concluded when the Seller sends confirmation that the Order has been accepted for processing to the Customer's e-mail address.
4. Before placing an Order the Customer is obliged to check that all Product parameters (artwork, material, size, crop) and address details are correct. Due to the bespoke nature of the Products, parameters cannot be changed once processing has begun.
5. The Seller may refuse to accept an Order or cancel it in the event of: failure to pay within the time limit, provision of false or incomplete details, or technical impossibility of producing a Product with the selected parameters (of which the Seller will inform the Customer without delay, refunding the amount paid).
§ 6. Processing and delivery
1. The Order processing time is a maximum of 14 working days from the day the payment is credited. During this time the Product is printed, quality-checked, packed and dispatched.
2. Delivery is by courier to the address given in the Order. Delivery cost: within Poland PLN 49, to other countries EUR 79, unless otherwise indicated in the cart. Rigid materials are packed in cardboard boxes with corner protection, wallpapers in tubes.
3. The Customer (or the person receiving the parcel) is asked to check the condition of the parcel in the presence of the courier. In the event of visible damage to the packaging or the Product, please draw up a damage report with the courier and contact office@artmonte.com - this makes handling the complaint easier but is not a condition for submitting one.
4. The risk of accidental loss of or damage to the Product passes to the Consumer when the Product is handed over to them by the carrier.
§ 7. Right of withdrawal
1. The Products offered in the Shop are goods that are not prefabricated, are made to the Consumer's specifications and are clearly personalised (individually chosen artwork, material, size and crop). Pursuant to Article 38(1)(3) of the Polish Consumer Rights Act of 30 May 2014 (implementing Article 16(c) of Directive 2011/83/EU), the right to withdraw from a distance contract does not apply to such Products.
2. The Customer is informed of the absence of the right of withdrawal before placing the Order and, by accepting the Terms and Conditions, confirms that they have taken note of this information and that they are ordering a Product made to their individual specifications.
3. The absence of the right of withdrawal does not limit the Customer's rights arising from the Product's lack of conformity with the contract (§ 8).
§ 8. Complaints (lack of conformity with the contract)
1. The Seller is obliged to deliver a Product that conforms to the contract. Towards Consumers, the Seller is liable for the Product's lack of conformity with the contract under the rules set out in chapter 5a of the Consumer Rights Act (conformity of goods with the contract); towards other Customers - under the statutory warranty rules of the Polish Civil Code, subject to paragraph 7.
2. A lack of conformity with the contract includes in particular: damage to the Product in transit, a size other than that ordered (with a tolerance of ±3 mm resulting from the cutting technology), a material other than that ordered, printing of a different artwork or a different crop than the one selected, and significant printing defects (streaks, missing sections, surface damage).
3. The following do not constitute a lack of conformity with the contract: colour differences resulting from monitor calibration and the properties of the material (§ 3(3)), features of the artwork visible in the preview (e.g. craquelure, signs of age, the texture of the original captured in the reproduction), and the material characteristics described on the material page.
4. A complaint may be submitted by e-mail to office@artmonte.com or in writing to the Seller's address, stating the Order number, a description of the lack of conformity, photographs of the Product and the packaging, and the remedy requested (repair, replacement, price reduction or - where the lack of conformity is significant - withdrawal from the contract).
5. The Seller will respond to a complaint within 14 days of receiving it. Failure to respond within this period is deemed acceptance of the complaint.
6. If a complaint is accepted, the cost of returning the Product (where required) is borne by the Seller; the Seller agrees the method of collection or return with the Customer.
7. In relation to Customers who are not Consumers, the Seller's liability under the statutory warranty is excluded and liability for damages is limited to the value of the Order.
§ 9. Customer account and newsletter
1. The Customer may create an account in the Shop, which allows them to view their Order history and save a list of favourite artworks. The account may be deleted at any time by sending a request to office@artmonte.com.
2. Subscribing to the newsletter is voluntary and constitutes consent to receive commercial information about new artworks and offers from the Shop. Consent may be withdrawn at any time via the link in the message or by contacting office@artmonte.com.
3. The Customer is obliged to use the Shop in accordance with the law and good practice, in particular not to supply unlawful content and not to take any action that interferes with the operation of the Shop.
§ 10. Out-of-court dispute resolution
1. A Consumer may use out-of-court methods of handling complaints and pursuing claims, including applying to a permanent consumer arbitration court attached to the Regional Inspectorate of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej), applying to the regional inspector of the Trade Inspection for mediation, or obtaining free assistance from a district (municipal) consumer ombudsman. Details: uokik.gov.pl.
2. A Consumer from the European Union may use the online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr. The Seller's e-mail address for contact in this matter: office@artmonte.com.
§ 11. Personal data
The controller of Customers' personal data is the Seller. The rules for processing data, including the purposes, legal bases, recipients and the rights of data subjects, are described in the Privacy Policy, which forms an integral part of these Terms and Conditions.
§ 12. Final provisions
1. The Seller reserves the right to amend the Terms and Conditions for important reasons (changes in the law, changes to payment or delivery methods, changes to the range offered). Amendments do not apply to Orders placed before they come into force. The current version of the Terms and Conditions is always available at artmonte.com/strona/regulamin.
2. Matters not covered by these Terms and Conditions are governed by Polish law, in particular the Civil Code and the Consumer Rights Act. The choice of Polish law does not deprive the Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
3. Disputes with Customers who are not Consumers are settled by the court having jurisdiction over the Seller's registered office.
4. The Terms and Conditions may be saved by downloading or printing this page.
